EGLE Creates Suggested Local Ordinance on Groundwater Use
Michigan Ag Connection - 12/03/2020

The Michigan Department of Environment, Great Lakes, and Energy's (EGLE) Remediation and Redevelopment Division (RRD) has developed suggested format and contents for when a proposed local ordinance or amendment of an existing local ordinance is relied on to limit or prohibit the use of contaminated groundwater in certain areas of a municipality.

A local ordinance may be used as an institutional control pursuant to Section 20121(8) of Part 201, Environmental Remediation, or Section 21310a(3)(a) of Part 213, Leaking Underground Storage Tanks, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended.

The model document and checklist are located on the EGLE's Land or Resource Use Restrictions webpage under "Local Ordinances, Health Codes, and Other."

For questions regarding the model document, please contact Kevin Schrems, EGLE, RRD, at 517-275-1180, or SchremsK@Michigan.gov.
